THE BASICS ABOUT AGENCY SHOP/FAIR SHARE
What exactly is agency shop?
Agency shop means that all employees in eligible bargaining units must pay their fair share to support the ongoing work of the association, such as representation, negotiations, etc. Since all employees share in the benefits of representation, agency shop provides two alternatives for sharing the cost of representation:
1. Pay full association dues as an association member; or
2. If you choose not to be a member, to pay a service fee not to exceed the amount of the periodic dues and general assessments of the association.
Employees who are members of a religion which has historically held conscientious objections to joining or supporting unions will be allowed to pay an amount equivalent to the service fee and general assessments to a designated charity.
Who can vote for agency shop?
All employees in the Orange County Attorneys Association bargaining unit.
Why should I vote for agency shop?
It’s only fair that all employees pay their share for the work of our association and the benefits of representation. With everyone supporting the association, we’ll be that much stronger in contract negotiations. We’ll be better able to achieve pay equity and fair salary increases, defend job security and improve working conditions. Also, we will be more effective in enforcing the contract and representing members in grievance proceedings.
Do other public employees have agency shop?
Yes, SEIU Chapter 787 and other labor organizations representing Orange County Employees currently have agency shop language in their MOU’s. If ratified, agency shop would include all employees in our bargaining unit, regardless of date of hire. When we succeed at this election, we will have a stronger union.
Why is agency shop campaign being held now?
Associations such as ours are under attack. The governor would like to prevent retirement programs such as the one we just negotiated. He would also like to prevent the creation of, and stop the growing influence of, groups such as the United Employees of Orange County (UEOOC) of which OCAA, the Orange County Deputy Sheriffs Association, the Orange County Employees Association, the Service Employees International Union and the International Union of Operating Engineers are all members. As you know, the Orange County Attorneys Association is involved in contract re-opener discussions pertaining to salary and benefit adjustments. Agency shop will make us more powerful at the bargaining table and in day to day enforcement of our contract.

We the undersigned employees of Orange County who are members of the
Orange County Attorneys Association bargaining unit, pursuant to Government Code
section 3502.5(b) hereby petition for an election to :
1. Implement a Full
Agency Shop provision that would apply to all employees
of the bargaining unit.
We believe that we are stronger together, and that we can accomplish
more if everyone contributes their fair share.
